Personal data refers to any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, particularly by reference to an identifier such as a name, identification number, location data, online identifier, or one or more specific elements of the physical, physiological, genetic, mental, economic, cultural, or social identity of that person.

- Sources and Categories of Processed Personal Data
The controller processes personal data that you have provided to them or personal data that the controller has obtained based on the fulfillment of your order:
- First name and last name
- Email address
- Postal address
- Phone number
- ...
- The controller processes your identification and contact details, as well as data necessary for the performance of the contract.
III. Legal Basis and Purpose of Processing Personal Data
- The legal basis for processing personal data is:
- Fulfillment of the contract between you and the controller under Article 6(1)(b) of the GDPR,
- Compliance with a legal obligation of the controller under Article 6(1)(c) of the GDPR,
- Legitimate interest of the controller in providing direct marketing (particularly for sending commercial communications and newsletters) under Article 6(1)(f) of the GDPR, Your consent to the processing for the purpose of providing direct marketing (particularly for sending commercial communications and newsletters) under Article 6(1)(a) of the GDPR in connection with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in the case where no goods or services have been ordered.
- The purpose of processing personal data is
- Processing your order and fulfilling the rights and obligations arising from the contractual relationship between you and the controller; when placing an order, personal data is required, which is necessary for successful order fulfillment (name, address, contact information). Providing personal data is a mandatory requirement for entering into and fulfilling the contract. Without providing personal data, it is not possible to conclude the contract or fulfill it by the controller,
- Compliance with legal obligations towards the state,
- Sending commercial communications and conducting other marketing activities.
- The controller does not carry out automated individual decision-making as per Article 22 of the GDPR. You have given your explicit consent for such processing.
- Retention Period of Data
- The controller retains personal data:
- For the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller, and to assert claims from these contractual relationships (for a period of 15 years after the termination of the contractual relationship),
- For the period until consent for processing personal data for marketing purposes is withdrawn, but no longer than 1 year, if personal data is processed based on consent.
- After the retention period, the controller will erase the personal data.
- Recipients of Personal Data (Sub-processors of the Controller)
Recipients of personal data include individuals:
- Involved in the delivery of goods/services/payment execution based on the contract,
- Providing e-shop operation services (Shoptet) and other related services,
- Providing marketing services.
- The controller does not intend to transfer personal data to a third country (outside the EU) or an international organization.
- Data Processors
- Personal data processing is carried out by the controller, but personal data may also be processed by the following data processors:
- Service provider Mailchimp,
- Potentially other providers of processing software and services that the controller currently does not use.
- Your Rights
- Under the conditions set out in the GDPR, you have the right to:
- Access your personal data as per Article 15 GDPR,
- Rectify your personal data according to Article 16 GDPR, or request restriction of processing under Article 18 GDPR,
- Erase your personal data according to Article 17 GDPR,
- Object to processing according to Article 21 GDPR,
- Data portability under Article 20 GDPR, and
- Withdraw your consent to processing in writing or electronically to the address or email of the controller provided in Article III of these terms.
- Additionally, you have the right to lodge a complaint with the Office for Personal Data Protection if you believe your right to personal data protection has been violated, or you may contact the court.
VII. Data Security Conditions
- The controller declares that they have adopted all appropriate technical and organizational measures to secure personal data.
- The controller has implemented technical measures to secure data storage systems and physical personal data storage.
- The controller declares that only authorized persons have access to personal data.
VIII. Final Provisions
- By submitting an order through the online order form, you confirm that you are familiar with the personal data protection conditions and that you accept them in their entirety.
- You agree to these conditions by ticking the consent box through the online form. By ticking the consent box, you confirm that you are familiar with the personal data protection conditions and that you accept them in their entirety.
- The controller is entitled to modify these conditions. The new version of the personal data protection conditions will be published on their website, and you will also be sent the new version of these conditions to the email address you provided to the controller.
These conditions come into effect on May 25, 2018.
